Description: Our engaging and informative faculty will help those navigate the statutory framework of the American with Disabilities Act and will provide guidance on advising employers and employees in this complex area. In addition, those who attend will learn about litigating and defending ADA cases, including legal theories of recovery, exhaustion of administrative remedies, proving and defending a case, and remedies. Among the topics our faculty discusses are:
- Statutory framework, including the Americans with Disabilities Act Amendments Act of 2008 (ADAA), Rehabilitation Act, Congressional Accountability Act, and state statutes.
- Important coverage definitions under the ADA.
- “Disability”
- “Major life activities”
- “Substantially limits”
- “Regarded as”
- Medical examinations/confidentiality.
- What a reasonable accommodation/undue hardship is
- Proving or defending an ADA case.
- Remedies.
- Hot topics in the law.
