Over 3000 DC residents apply for Social Security Disability benefits each year and after months and often years of Social Security administrative appeals, many deserving claims are denied after a final determination by the SSA Appeals Council. With this final decision the United States District Courts have jurisdiction to review the decision. With the power to affirm, modify or reverse the SSA’s decision, the federal District Court can be the most thorough review of a client’s disability case. But what makes for a good disability case to appeal to federal court?
This live webinar will include:
- Analyzing the merits of a decision to appeal to U.S. District Court
- Scope of judicial review
- Steps for filing the civil complaint
- The briefing process and practice tips for a winning disability brief
- The role of Magistrate Judges
- Tips for accepting a new case at the federal district court appeals level
- Fees under the Equal Access to Justice Act
PLEASE NOTE: Training participants must agree to accept one pro bono case within three months of this training. This training requirement is waived for attorneys employed by legal services providers.
