In the first of this three-part program, employment law expert Robert Fitzpatrick will review employment decisions from 2023 from the D.C. Circuit and the D.C. Court of Appeals, walking through short summaries and key holdings. In this first segment of the annual employment law update, we will review several important decisions from the D.C. Circuit, including:
- The effect of Wright v. Eugene & Agnes E. Meyer Foundation on non-disparagement clauses and defamation claims
- Important procedural questions related to dismissal, summary judgment, and class actions (Perez v. Kipp, Bastami v. AFGE, Ramos v. Garland, In re Valerie White, Harris v. Medical Transp. Mgmt., Inc.)
- Judicial doctrines on standing, mootness, and tolling (Robinson v. DHS Office of IG, Payne v. Biden, Scott-Anderman v. Martinez, ITServe Alliance, Inc. v. DHS)
- Rights of federal sector employees (Benerman v Blinken - foreign service, Orozco v Garland - Rehab Act, Langeman v Garland - due process)
- IRS Whistleblower awards (Villa-Arce and Lissack)
This segment will also review decisions from the D.C. Court of Appeals addressing:
- The D.C. Human Rights Act (Sampay v. Am. Univ.; Felton v. Am. Assoc. of Social Workers; and D.C. v. Bryant)
- The Anti-SLAPP Act (Salem Media Grp., Inc. v. Awan)
- Hot issues in wage-hour law (Wright v. Office of Wage Hour, Lecea v. DOES)
