Description: This interactive and popular class provides valuable information on the procedural framework and substantive rules governing the established administrative personnel security due process provided by the Defense Office of Hearings and Appeals. Those who attend will learn about the national security adjudicative guidelines issued by the Director of National Intelligence, which became effective in 2017. Our experienced and engaging presenter will also address the effect of Executive Order 13764, which modernizes and strengthens how the federal government performs and safeguards background investigations for its employees and contractors. The class will also cover the Federal Circuit decision in Wonders v. Department of the Army, and its effect on transparency in administrative due process, as well as the latest DoD administrative security clearance case decisions.
The presenter will walk those who attend through simulations in which they must use their knowledge of the rules, procedures, and the case decisions discussed during the class to decide how the cases should turn out. We strongly recommend this class for practitioners who represent or anticipate representing military personnel, civilian employees of the Department of Defense, or officers and employees of defense contractors (or the contractors for thirty-two other federal departments and agencies) who face a decision to deny or revoke their access to classified information.
