Description: The ethics rules regarding with whom an attorney may communicate, what information the attorney may seek to obtain, and what disclosures an attorney must provide to a person before commencing communications, can be a minefield for attorneys unfamiliar with the finer points of the applicable rules. Join us for this informative and practical class that provides a comprehensive analysis of which parties, witnesses, and others an attorney may communicate with, and what the attorney may or may not discuss with such persons, with a particular emphasis upon communicating with unrepresented persons. The following are among the subjects our faculty expert will discuss.
Circumstances under which an attorney may give legal advice to an unrepresented person
Information that an attorney must provide to an unrepresented person before commencing communications
Communications with a represented person who is considering firing their lawyer
Negotiating settlement terms on behalf of an unrepresented person
Attorney-client privilege issues when speaking with a former employee of an adverse party
How the substantive law impacts the ethics rules regarding communications
Relevant choice of ethics law issues
