Description: The ethics rules regarding with whom an attorney may communicate, what information the attorney may seek to obtain, and what disclosures an attorney must provide to a person before commencing communications, can be a minefield for attorneys unfamiliar with the finer points of the applicable rules. Join us for this informative and practical class that provides a comprehensive analysis of which parties, witnesses, and others an attorney may communicate with, and what the attorney may or may not discuss with such persons, with a particular emphasis upon communicating with unrepresented persons. The following are among the subjects our faculty expert will discuss. 

  • Circumstances under which an attorney may give legal advice to an unrepresented person
  • Information that an attorney must provide to an unrepresented person before commencing communications
  • Communications with a represented person who is considering firing their lawyer
  • Negotiating settlement terms on behalf of an unrepresented person
  • Attorney-client privilege issues when speaking with a former employee of an adverse party
  • How the substantive law impacts the ethics rules regarding communications
  • Relevant choice of ethics law issues
While litigators will find this class of particular interest, all attorneys can benefit by attending.
