Description: Join our experienced and knowledgeable faculty as they provide an update on current enforcement priorities for noncitizens and explain the immigration consequences of certain criminal activities and convictions. Those who attend will learn about the Department of Homeland Security’s enforcement priorities, and the practicalities of enforcement given current resources. The panel discusses the elements necessary for the government to establish a conviction for immigration purposes, and the crimes that can result in a noncitizen’s deportation, with a focus on crimes in the District of Columbia, Maryland, and Virginia. They also address possible forms of relief to avoid deportation.
Other topics include the U.S. Supreme Court’s decisions in Padilla v. Kentucky and its progeny. This discussion includes what defense counsel must do to comply with the Court’s mandate in Padilla, and how defense counsel’s failure to provide adequate advice to noncitizen clients on the immigration consequences of criminal convictions can result in malpractice claims and constitute a breach of the attorney’s ethical obligations.
