ON DEMAND: Supplemental Environmental Projects and What They Mean for Stakeholders
The program will bring together four diverse perspectives from the federal government, academia, industry, and the nonprofit community to discuss Supplemental Environmental Projects (SEPs) and what they mean for stakeholders.
An SEP is an environmentally beneficial project or activity that is not required by law, but that a defendant agrees to undertake as part of the settlement of an enforcement action. During the Trump Administration, the United States Department of Justice (DOJ) issued internal guidance and a rule that halted the DOJ’s incorporation of SEPs in civil environmental actions. On May 5, 2022, Attorney General Garland issued a memorandum and an interim final rule, published on May 10, 2022, that restored the DOJ’s authority to enter into SEPs in federal civil and criminal cases, subject to certain guidelines outlined in the memorandum and final rule. The United States Environmental Protection Agency (EPA) has a long-standing policy, last updated in 2015, encouraging the use of SEPs in appropriate enforcement actions, which has remained in effect across multiple administrations.
