Description: This interactive class incorporates a series of video vignettes the Association of Professional Responsibility Lawyers (“APRL”) have produced and is designed to present fact scenarios that illustrate various ethical issues that often arise.
The vignettes will show volunteer attorneys who role-play different encounters between attorneys and their clients, or attorneys themselves. The vignettes highlight various ethical issues in a way that will promote a frank discussion of the principles and policies that underlie the rules and the boundaries of their application, which discussion our faculty experts will facilitate.
Among the issues the faculty will discuss are:
A purported conflict of interest with a firm’s in-house counsel where the complaining client is not a party in the matter
A limited scope representation that leads to unanticipated client expectations
The sufficiency of a partner’s supervision of associates and nonlawyer employees
An attorney’s expression of concern to a client about the client’s use of legally prohibited products in its construction work
A consumer protection attorney who enters into a settlement agreement in a product liability case with a problematic provision concerning future litigation
An attorney who comes to learn of another attorney’s intentional misappropriation of a client’s money, but the client does not want the attorney to report it to disciplinary counsel
Whether two attorneys who handle tax assessment cases for a county can leave their jobs and form a law firm to oppose the county in such matters.
This class will provide practical advice in navigating the ethical dilemmas that attorneys often encounter and is a must for all practitioners regardless of their firm or organization size, and areas of practice.
