In this two-part series, nationally recognized faculty expert Tom Spahn provides an in-depth exploration of both doctrines, blending foundational principles with the latest case law and practical insights. Regardless of the nature of your practice, you will gain the tools needed to recognize, preserve, and effectively assert these critical protections in litigation, regulatory matters, corporate investigations, and beyond.
 
Class Description: In this class, our distinguished presenter turns to the work product doctrine, offering a comprehensive analysis of 2025’s most important trends, legal developments, and practical applications. This class explores when and how the doctrine applies in a variety of legal contexts and provides a deeper understanding of its core principles, including the “litigation,” “anticipation,” and “motivation” elements. The class also addresses common misconceptions about the doctrine’s scope, highlights the sources of proof courts rely on when evaluating claims, and provides strategies for maximizing protection while avoiding inadvertent waivers.
 
Additional topics include recognizing what falls outside the doctrine’s protections and managing work product issues before, during, and after internal corporate investigations.
