The generation-skipping transfer (GST) tax is like the villainous Voldemort from Harry Potter – so feared that no one speaks its name. As a result, estate planners focus on preventing the tax, and very little information exists on paying the tax in the event of a direct skip, taxable termination or taxable distribution. This presentation focuses on planning for GST non-exempt trusts. The panelists will challenge the common assumption that it is better to have the estate tax apply instead of the GST tax, and the presentation will also address the mechanics of paying the GST tax, who is liable for it, and what deductions are available when tax is due.
