In light of the IRS’s indication that it is considering issuing guidance in the area, this panel will take a look at the rules regarding worthless stock deductions under section 165(g). The panelists first will cover the basics of section 165(g) and then examine some of the more complicated an uncertain aspects of the operation of section 165(g), particularly with respect to the gross receipts test and the application of section 165(g) in a consolidated group.
