Description: President Biden’s recent Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence proposes extensive legislative and regulatory action around AI-based systems, all of which will impact how attorneys advise their clients on the use of AI systems, for both traditional machine learning, and newly adopted generative AI platforms. From the role of the new AI Safety Institute under the Department of Commerce, and the activity at the Department of Homeland Security, to the expansion of the resources based on the NIST AI Risk Management Framework, regulatory specifics are developing quickly. In addition, other federal agencies continue to provide guidance around uses of AI in various contexts. State and international laws are advancing as well.
