Description: In the initial class in our Statute Drafting and Regulatory Process Workshop Series, we delve into the essential principles of administrative law that shape the drafting of regulations. This interactive class guides you through the informal rulemaking process under the Administrative Procedure Act, providing practical insights into the structure and nuances of regulatory drafting. Key topics include the following:
- Understanding the anatomy of a rule – Explore the components of a regulation, including required elements of the preamble
- Common drafting challenges – Learn to navigate frequent issues that arise in regulation text and ensure clarity and compliance
- Drafting choices – Examine the options available at each stage of drafting, from structure to language choices
Participants also engage in hands-on exercises, draft a regulation with expert guidance, and gain valuable experience in crafting legally sound, effective regulatory text. This class is ideal for attorneys working in rulemaking or agency regulation, as well as others interested in understanding the intricacies of the regulatory drafting process.
