Join us as Professor Kristin Hickman, the McKnight Presidential Professor of Law at the University of Minnesota Law School, and David Foster, a tax partner at Skadden, Arps, Slate, Meagher & Flom LLP, discuss current developments in the applicability of the Administrative Procedure Act (APA) to IRS and Treasury rulemaking and regulatory guidance. Professor Hickman and Mr. Foster will discuss the Sixth Circuit's Mann Construction decision earlier this month and the Eleventh Circuit's recent decision in Hewitt, as well as other pending cases, with a focus on how cases applying the APA to IRS rulemaking/guidance may impact taxpayers and practitioners and open issues that remain following these decisions.
